What's new

All employers in the UK have a responsibility to prevent illegal working. You do this by conducting simple right to work (RTW) checks before you employ someone, to make sure the individual isn't disqualified from carrying out the work in question because of their immigration status. This activity looks at the three ways in which you can complete right to work checks.

This activity is suitable for employers, including your Human Resource team and those team members within the business with responsibility for the recruitment and employment of individuals.

By the end of this activity, you'll be able to:

  • Define the purpose and methods of right to work checks.

  • Describe what a statutory excuse is and how to prove one for right to work checks.

  • Explain how to deal with EEA (European Economic Area) citizen checks.

Section 1 – Introduction to right to work checks

In this section, you'll learn about:

  • The ways in which you should ask employees to prove their right to work.

  • Who needs to be aware of right to work checks.

  • Why it’s important to prevent illegal working.

  • Relevant legislation.

  • Sanctions against illegal working.

Section 2 – Establishing a statutory excuse

In this section, you'll learn about:

  • What a statutory excuse is.

  • Three steps in conducting a manual document-based check.

  • Employment of specific categories of workers, sponsored work routes, and supplementary employment.

  • Acceptable documents you may accept as proof and checking their validity.

  • Retaining evidence and records.

  • Checks using an Identity Service provider (IDSP).

  • Conducting a Home Office online right to work check.

  • Biometric Residence Permits.

  • Follow up checks.

  • In-time applications (3c leave).

Section 3 – EEA Citizens

In this section, you'll learn about:

  • How to conduct checks for EEA and Irish Citizens.

  • How EEA citizens must prove their right to work.

  • Employment of Ukraine nationals.

  • Outstanding UK EU Settlement Scheme applications.

  • Frontier workers.
